Welcome to the Motorcycle 2012. These Terms & Conditions apply to the use of this website at www.motorcycle2012.yolasite.com By accessing this website and/or placing an order, you are agreeing to our Terms & Conditions. 

Using this website indicates that you accept these terms regardless of whether or not  you choose to register with us or order from us. If you do not accept these terms, do not use this website. 

1.1 You will be able to access all areas of this Website without registering your details with us.
1.2 We may revise these Terms and Conditions at any time by updating this page. You should check this Website from time to time to review the current Terms and Conditions. Certain provisions of these Terms and Conditions may be superseded by expressly designated legal notices or terms located on particular pages of this Website. If you do not wish to accept any new Terms and Conditions after we have given notice, you should not continue to use this Website.

2. ORDERING FROM US...

2.1 You are deemed to place an order with us by ordering via our online checkout process. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement, detailing the products you have ordered.
2.2 Our acceptance of an order takes place when we dispatch the order. We will send you a dispatch confirmation by email. When we dispatch the order the purchase contract will be made even if your payment has been processed immediately, unless we have notified you that we do not accept your order or you have cancelled your order.
2.3 We may refuse to accept an order:
(a) where goods are not available;
(b) where we cannot obtain authorisation for your payment;
(c) if there has been a pricing or product description error; or
(d) if you do not meet any eligibility criteria set out in our Terms and Conditions.

3. PRE-ORDERING INFO...

3.1 What is a pre-order? - It's a way to reserve our hottest new products before their initial release.
3.2 When will my pre-order be shipped? - The pre-ordered item will be shipped on its release date. All other items will be processed for immediate shipment, depending on availability. So if you ordered other items along with the pre-ordered item, you will most likely get the other items first.
3.3 When will I be charged for my pre-order? - We won't charge your credit card until the item actually ships. If you order other items together with the pre-ordered item, you will be charged for the other items when we ship them and then for the pre-ordered item when it is shipped.
If you are using a debit card, your bank may place a hold on the authorised funds, but we won't collect the funds until the item/s are shipped. If you are using Paypal your payment will be collected in advance.
3.4 What do you mean by "expected" release date? - We can't always predict the exact date a pre-ordered item will become available.
We will ship your pre-order as soon as possible, but we can't guarantee a specific date. If the date changes or for unforeseen circumstances the product becomes unavailable, we will alert you by email.
3.5 Can I cancel a pre-order? - You can cancel a pre-order at any time prior to when your order is dispatched. 

4. PRICING...

4.2 Where we charge separately for packing, carriage and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown elsewhere on this Website.
4.3 Our prices are reviewed monthly.
4.4 All orders placed on our site are in Peso selling.

5. CANCELLATION AND RETURNS POLICY...

We at motocross2012 accept returns on the basis that the item/s are un-used, and in the original re-saleable condition. All packaging and/or cellophane wrapping and tamper resistant seals must be intact. Due to health and hygiene reasons we are unable to accept returned underwear garments.

Return of goods is the responsibility of the customer, for this reason we suggest an insured method of return such as Recorded Delivery. Return postage costs cannot be covered by Dirtbikexpress unless damaged or faulty goods. 

You must inform us of your intent to return your item/s by phone or email within 7 days of receiving your order. If you inform us within this period you will receive a full refund. If you inform us after this 8 day period the refund will be subject to a restocking charge of 20% to be deducted off of the refund total. 
Please Note: Returns are not accepted on special order (bike specific) products which also includes tyres. 

When returning an item/s, please complete the Returns Form enclosed with your delivery, or enclose a covering letter detailing your name, contact phone number, invoice number and reason for return. 

For exchange of items, please note that an additional fee will be payable to re-deliver your item/s. Large item/s delivered by Courier - £9.99, smaller item/s delivered by Royal Mail Recorded Delivery - £4.99.

6.1 Links to third party websites on this Website are provided solely for your convenience. If you use these links, you leave this Website. We have not reviewed all of these third party websites and do not control and are not responsible for these websites or their content or availability. We therefore do not endorse or make any representations about them, or any material found there, or any results that may be obtained from using them. If you decide to access any of the third party websites linked to this Website, you do so entirely at your own risk. 
6.2 If you would like to link to this Website, you may only do so on the basis that you link to, but do not replicate, the home page of this Website, and subject to the following conditions:

We expressly reserve the right to revoke the right granted in this clause 9.2 for breach of these terms and to take any action we deem appropriate.
9.3 You shall fully indemnify us for any loss or damage we or any of our group companies may suffer or incur as a result of your breach of clause 9.2.

9. GOVERNING LAW AND JURISDICTION...

9.1 These Terms and Conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the English courts.
9.2 We do not warrant that materials/items for sale on the Website are appropriate or available for use outside the United Kingdom. It is prohibited to access the Website from territories where its contents are illegal or unlawful. If you access this Website from locations outside the United Kingdom, you do so at your own risk and you are responsible for compliance with local laws.

When you visit, register or order products or services onwww.dirtbikexpress.co.uk you may be asked to provide certain information about yourself including your name, contact details and credit or debit card information.

We may also collect information about your usage of our website as well as information about you from messages you post to the website and e-mails or letters you send to us.

To maintain customer service standards and to assist staff training, we may record and monitor incoming calls.
